These Terms & Conditions (“Terms”) govern your access to and use of https://www.werok.co.ke and any purchase or interaction with Werok Systems Limited(“Werok Systems”, “we”, “us”). By using this website, creating an account, requesting a quotation, or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
1. Eligibility & accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You are responsible for all activity under your account.
- We may suspend or close accounts that breach these Terms, are used fraudulently, or pose a security or legal risk.
2. Products, availability & pricing
- We operate a fast-sourcing model: some items are stocked locally and others are sourced to order. Availability and delivery timelines are indicative and not guaranteed until your order is confirmed.
- Prices are in Kenya Shillings (KES) and include applicable taxes as shown at checkout. Delivery fees are added where applicable.
- We make reasonable efforts to ensure accuracy, but product descriptions, images, prices and availability may contain errors. Where a genuine error is found, we may cancel or correct the order (with a full refund of any amount paid) before dispatch.
- An order is an offer to buy. A contract is formed only when we confirm acceptance and/or dispatch the goods. We may decline or cancel any order at our discretion (e.g. pricing errors, suspected fraud, or stock issues).
3. Payments
- We accept M-Pesa, card payments and (where offered) pay-on-delivery. Payments are processed by third-party providers; you agree to their terms.
- You warrant that any payment method you use is yours and that you are authorised to use it.
- We issue KRA eTIMS-compliant receipts/invoices for applicable transactions.
4. Delivery, risk & title
- We deliver within Nairobi and nationwide via our delivery partners. Delivery estimates are not guaranteed and we are not liable for delays outside our reasonable control.
- Risk in the goods passes to you on delivery. Title (ownership) passes once we have received payment in full.
- You must inspect goods on delivery and report any visible damage or discrepancy promptly (see our Refund Policy).
5. Warranties & genuine products
We supply genuine products. Manufacturer warranties (where applicable) apply per the manufacturer's terms. Except as expressly stated and as required by Kenyan law (including the Consumer Protection Act, 2012), all other warranties, conditions and representations are excluded to the maximum extent permitted.
6. Acceptable use
- Do not misuse the site, attempt to gain unauthorised access, introduce malware, scrape data, or interfere with its operation or security.
- Do not post unlawful, infringing, defamatory or abusive content in reviews, chats or messages. We may remove content and restrict access at our discretion.
7. Intellectual property
All content on this site — including the Werok Systems name, logo, text, graphics and software — is owned by or licensed to us and protected by law. You may not copy, reproduce or exploit it without our written permission.
8. Third-party links & services
The site may link to or rely on third-party services (payments, delivery, messaging). We are not responsible for third-party content or practices; their terms and privacy policies apply.
9. Limitation of liability
To the maximum extent permitted by law, Werok Systems Limited shall not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, data, goodwill or business, arising from your use of the site or products. Our total aggregate liability for any claim arising out of or related to an order shall not exceed the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under Kenyan law (including for death or personal injury caused by negligence, or fraud).
10. Indemnity
You agree to indemnify and hold Werok Systems Limited, its directors, employees and agents harmless from any claims, losses or expenses arising from your breach of these Terms or misuse of the site.
11. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, including outages, supplier failures, strikes, or acts of government.
12. Governing law & disputes
These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have exclusive jurisdiction. We encourage you to contact us first so we can try to resolve any issue amicably.
13. Changes
We may update these Terms from time to time; the version in force is the one published here at the time of your order.
